LuxeWorks Personal Training - Terms & Conditions/Customer Contract

LuxeWorks Personal Training is located at:

12990 Valley View Rd, Eden Prairie, MN 55344.

1. Payment Terms

PIF Packages

Clients will pay on a “Paid in full” basis, and packages will not renew automatically.

Bi-Weekly Packages

Clients will pay on a bi-weekly basis, and packages will renew automatically until a 30-day written notice is given.


2. Health Representation

Before using LuxeWorks Personal Training’s services or facilities, you represent that you are in good health and have no disability, impairment, injury, disease, or ailment preventing you from engaging in active or passive exercise or which could cause increased risk of injury or adverse health consequences as a result of exercise.


3. Assumption of Risk and Liability

You assume full responsibility for your use of any LuxeWorks Personal Training facility and shall indemnify LuxeWorks Personal Training, its affiliates, agents, and employees, against any and all damages arising out of your use of the facilities. Clients assume all risk of personal injury, death, or property loss resulting from any cause whatsoever, including negligence, breach of contract, or breach of any statutory or other duty of care.


4. Fees and Renewals

Clients agree to pay all applicable fees, charges, and taxes for their selected package and understand that all personal training contracts will continue to renew automatically until properly canceled. All clients are required to acknowledge and agree to the cancellation policy when signing the personal training contract. All sales are considered final. LuxeWorks does not offer refunds or exchanges for any products or services sold.


5. Cancellation Policy

30-Day Written Notice: Personal training clients wishing to cancel their personal training contracts must submit a written notice of cancellation 30 days prior to their desired cancellation date. The desired cancellation date must be outside of the package minimum length. During the 30-day notice period, clients can continue to enjoy services.Clients are responsible for any dues or fees incurred during the 30-day notice period. LuxeWorks reserves the right to terminate contracts for violations of policies or for any other reason not prohibited by applicable law.


6. Exceptional Experience Guarantee

At LuxeWorks Personal Training, we are committed to providing an exceptional fitness experience that exceeds your expectations. If, after your first personal training session, LuxeWorks Personal Training has not met your expectations, simply inform us, and we will take immediate action to address your concerns. Whether it’s providing complimentary equipment familiarization, enhancing our facility, or voiding the cancellation policy, we are dedicated to ensuring your satisfaction.


7. Three-Day Right of Rescission

This contract provides for the penalty-free cancellation of the contract within 3 days , exclusive of holidays and weekends, of its making, upon the mailing or delivery of written notice to LuxeWorks Personal Training. Refunds will be issued within 30 days after receipt of cancellation notice. LuxeWorks may retain a prorated amount based on the number of days or services used.


8. Facility Rules

Proper Attire

Proper athletic attire is required. LuxeWorks reserves the right to determine appropriate attire in its sole discretion.

Key Tag and Membership Proof

Clients must present the provided key tag or show proof of membership/contract each time they enter the facility.

Minors

All clients under the age of 16 (minimum age of 12) must be accompanied by an adult while using the facility.

Smoking Policy

Smoking, including e-cigarettes, chewing tobacco, and vapor pens, is prohibited at all times in all LuxeWorks facilities.


9. Personal Property

LuxeWorks Personal Training shall not be liable for the disappearance, loss, theft, or damage to personal property, including, but not limited to, money, jewelry, negotiable securities, or other items.


10. Image Usage Policy

While on LuxeWorks premises, you or your minor child’s image (including live or recorded video) may be used on LuxeWorks’ website or social media outlets (Facebook, Instagram, YouTube, etc.). By entering the premises, you consent to the use of these images.


11. Trainer Assignments and Session Policies

Session Frequency: Personal training sessions must be conducted at a minimum of 1 session per week unless other arrangements are made in writing. Scheduled sessions not rescheduled or canceled 24 hours in advance will result in forfeiture of the session unless otherwise arranged. Clients may be reassigned to a new trainer at any time.


12. Billing and Notices

You must promptly notify LuxeWorks in writing of any changes in your billing information, address, or telephone number. You expressly permit LuxeWorks or its authorized billing company to obtain updated information through payment card networks, card issuers, or third parties.


13. Contract Termination Due to Death or Disability

If a personal training client dies or becomes totally or permanently disabled, their contract shall automatically terminate as of the date of the client’s death or commencement of total disability. Proof of disability must be furnished by a licensed physician.


14. Cash-Free Facility

LuxeWorks Personal Training is a cash-free business. We do not accept cash or Apple Pay/tap-to-pay for personal training packages, merchandise, or supplements.


15. Non-Discrimination Policy

LuxeWorks Personal Training does not discriminate against any person because of sex, race, creed, age, color, origin, or sexual orientation.


16. Contract Validity

If any part of this contract is held invalid, that part shall be deemed excluded, and the remainder of the contract shall remain in full force and effect.


17. Business Closure or Relocation

If LuxeWorks goes out of business or relocates facilities more than 5 driving miles, clients may cancel their contracts and receive a prorated refund within 30 days.

18. Consent to Communications

By providing your contact information and agreeing to the terms and conditions, you consent to receive emails and text messages from LuxeWorks Personal Training. These communications may include account-related updates, promotional offers, and information about our services. Message and data rates may apply. You may opt-out at any time by using the unsubscribe link in emails or replying “STOP” to text messages.


19. Website Cookies

Our website uses cookies to enhance user experience, track activity, and improve site functionality. By continuing to use our website, you consent to our use of cookies. Users may block cookies via their browser settings, but doing so may affect website performance and limit access to certain services.


20. Payment Security

Payment information is processed securely through our third-party payment provider, Clover Connect. LuxeWorks Personal Training does not store sensitive financial data, such as credit card information. Transactions are encrypted and handled with secure SSL protocols.


21. Data Protection and Security

LuxeWorks Personal Training takes appropriate precautions to protect your information. Data submitted via our website is stored in secure databases and transferred using encrypted SSL protocols to safeguard sensitive information.
